Pennsylvania laws contain two levels of assault charges:

  • Simple Assault is a misdemeanor, with punishments from probation to jail.
  • Aggravated Assault is a felony, and references any assault that involves a weapon and/or involves serious bodily injury. Aggravated Assault is a more serious offense that is more likely to involve jail or prison. However, conviction of aggravated assault does not always involve incarceration.

Although Pennsylvania does not consider it a separate charge, there are special considerations in cases of Domestic Violence. When an alleged victim calls the police and makes an allegation, the police are required by law to make an arrest. The alleged victim cannot simply drop the charges in a case of domestic violence. This decision rests with the District Attorney. Consequently, you need a solid defense attorney to discuss a resolution with the District Attorney.
